Pregnancy is a wonderful waiting period for a baby. But there are many problems associated with it, for example, going on maternity leave. For its correct design, in accordance with the legislation, several points should be taken into account.
Instructions
Step 1
Go on maternity leave on the advice of a doctor, without persuading him to extend the working period. By law, this occurs in the thirtieth week of pregnancy. You can go on maternity leave earlier than this. To do this, you must provide the organization with a doctor's certificate, which will attest to a difficult pregnancy or other health problems of the expectant mother.
Step 2
Provide a sick leave for registration of maternity leave, as well as receiving benefits for pregnancy and childbirth, drawn up by your attending physician according to the established rules (namely, according to Article 13 of the Law of December 29, 2006 No. 255-FZ, paragraph 12 of the Regulation approved by the decree of the Government of the Russian Federation dated December 30, 2006 No. 865). A handwritten application for maternity leave is attached to the sick leave in accordance with article 255 of the Labor Code of the Russian Federation. The legislation has not established a clear pattern, therefore such a statement is written in an arbitrary form.
Step 3
Receive the order on the provision of maternity leave in the form No. T-6, drawn up on the basis of the documents submitted by you, issued by the head of the organization.
Step 4
Increase your maternity leave in case of difficult labor. The list of complications is contained in the Instruction of the Ministry of Health of Russia dated April 23, 1997, No. 01-97. Take a new sick leave from the doctor indicating the specific type of complications, write a new application for the extension of the decree, submit these documents to the organization. On their basis, the decree will be extended and the allowance will be paid in addition (by issuing a new decree).
Step 5
Take parental leave after birth. At the end of the maternity leave, the employee writes an application for granting her parental leave. It is considered by the head and issues an appropriate order.
