A conflict can arise between a woman and a man due to the fact of paternity. And if the man himself believes that the child is not his, he can refute paternity through the court if there is evidence of his innocence.
Instructions
Step 1
Do not give consent to record you as the child's father on the birth certificate. This is possible if you are not officially married to a woman who claims to have given birth to your child. In this situation, it will be her, not you, to sue and look for evidence. Please note that you can automatically be listed as the father of the child born to your wife, as well as the ex-wife, if no more than three hundred days have passed since the divorce.
Step 2
Make sure the baby was not really born of you. To do this, you need to conduct a genetic examination. If you are not on the birth certificate, the consent of his mother will be required. In the case when you are listed as his official father, you can do the examination yourself. This is a paid procedure and is performed in many medical centers. Often, you can even do without the presence of the child - for example, the doctor may ask you to take some hair or a saliva sample from the offspring, and then send it to the clinic. It all depends on what kind of genetic material is being analyzed by a particular medical center. Please note that the data of such an examination will be useful to you only for personal use, the court will not accept them.
Step 3
If the child turns out to be a stranger, and you appear in the documents as a father, file a lawsuit that you are not a father. You can attach documents confirming your version to the application. For example, if you were on a business trip at the estimated time of conception, take a certificate from work.
Step 4
The court will schedule a meeting for you to appear. Also, the judge can oblige the parents to carry out a genetic examination, but already in that medical institution, whose results will be accepted for consideration. If you disagree with the court's decision, appeal to a higher authority.
