How can you force your husband to support the child and pay child support? This question, unfortunately, does not lose its relevance. There are several ways to hold a man accountable.
It is necessary
- - submit documents to the magistrate's court;
- - attach all the necessary originals of documents and their copies (passport, marriage certificate, child's birth certificate, certificate from housing authorities about the child's registration);
- - pay the state duty;
- - regularly visit the bailiff.
Instructions
Step 1
Submit an application for the recovery of child support to the magistrate's court at the place of residence of the defendant (husband). In this case, it is not at all necessary to divorce. Alimony could be collected without divorce. Collect all the documents necessary for the statement of claim: an application for the recovery of alimony and its copy, your passport and a copy, a marriage certificate (copy), a birth certificate of the child (children) and their copies, a certificate from the housing authorities about the child's registration. Do not forget to pay the state duty receipt (if you are only submitting an application for the collection of alimony, then you do not need to pay the state duty).
Step 2
Please note that alimony starts to accrue from the day the application is filed, and not after the case is considered, so do not hesitate to submit the documents.
Step 3
Please note that there are two types of alimony, and if the child is less than three years old, you have the right to file a second statement of claim for the accrual of alimony for your own maintenance. The amount of the alimony will be determined by the judge.
Step 4
If you have already received a court decision on the recovery of alimony, then you need to transfer it at the place of residence of the defendant to the bailiff service. Now the laws have become tougher and the bailiffs have a legal basis to exert pressure on unscrupulous alimony workers. If you do not receive the next payment for a month, be sure to contact the bailiff service. Do not bring information orally or by phone, be sure to write written statements, keep all receipts of the amounts received, for subsequent recalculation and collection of debts.
Step 5
In case of systematic evasion from the payment of alimony, the bailiffs have the right to carry out an inventory and seizure of the defendant's property. If these measures do not help (or there is nothing to describe), then you have the right to file a statement of claim in court and bring the unscrupulous husband to criminal liability.
