After entering information about you and your child in the registry books, you will receive 2 documents: a certificate of paternity and a birth certificate. So the baby will officially find a father and receive the same rights in relation to him as children born in a registered marriage.

In addition, the father can submit an individual application for establishing paternity on a voluntary basis if the child's mother has died, is declared incapacitated, has been deprived of parental rights, or her whereabouts have not been established.

If the father evades recognizing the baby as his own and the responsibilities of a parent, apply to the court at his place of residence with a statement of claim to establish paternity. In the application, indicate the name of the court, your last name, first name, patronymic, residential address, the same data of the defendant. Note whether you were in a de facto marriage relationship, that is, lived together and shared a household. Please provide evidence supporting the cohabitation (certificates from housing authorities, correspondence, postcards, letters, money orders, photographs, testimony of witnesses, etc.).

Next, write that you had a common child, but his father does not recognize himself as such and refuses to take part in his upbringing and maintenance. State your requirements: establish paternity, collect child support, question witnesses, etc. If necessary, apply for a molecular genetic examination. Keep in mind: if the defendant refuses to carry it out, the court has the right to satisfy your claim immediately and recognize paternity and without examination.

Having received a court decision in your favor, contact the registry office with a statement on establishing paternity. Pay the state duty in the amount of 200 rubles, attach the receipt to the application.
