Step 1
If you have a child, you will not be able to file a divorce through the registry office. To do this, contact the magistrate at the place of your registration. If the desire to separate from the spouses is mutual, there is no dispute over who the baby should stay with, there will be no problems. If there is a disagreement between you and your husband, write a divorce petition to the district court.
Step 2
So that the divorce procedure does not drag on for a long, long time, talk with your spouse in advance and decide with whom the child will stay, how the jointly acquired property will be divided, what will be the procedure for communicating with the baby, how alimony payments will be made and in what amount. Also discuss a number of other issues that concern you. After that, do not forget to certify all your agreements in writing with a notary. Come to court with these documents and let the judge look at them.
Step 3
Write your application in duplicate. You can see an example of filling in the court itself. Pay the state duty through Sberbank, save your receipt. Take your marriage certificate and child's birth certificate and go to court. If these documents are lost, contact the registry office to restore them.
Step 4
After the time indicated by the specialist, come to the court session. If not only you, but also your spouse write a statement for divorce, you will be divorced immediately. If your husband is against the dissolution of the marriage, the judge may grant a grace period of up to several months for possible reconciliation.
Step 5
If your spouse wants the child to live with him and files a lawsuit in the district court, you will need to contact an experienced lawyer. The fact is that the judge will decide with whom to leave the child, based on various factors: financial situation, living conditions of the spouses, etc.
