Many managers are annoyed by employees (mothers or fathers), who often miss work due to the illness of their children. Sometimes parents themselves do not show the desire to go to the "children's" sick leave once again, so as not to lose money, because in our time they are not superfluous. It would be nice if someone from the family could issue a sick leave for themselves … For example, a grandmother. And it is possible!

Based on the current legislation of Russia, we can conclude that any family member who actually provides this care has the opportunity to take care of a sick child. The law does not stipulate the degree of such kinship, therefore, such a person can be any of the existing relatives, including the baby's grandmother.

What regulatory legal acts govern the receipt of sick leave and payments under it?

  • Order No. 84 of 2008 of the Ministry of Health and Social Development of the Russian Federation.
  • Federal Law No. 255 - Article 5.
  • Order No. 624N of the Ministry of Health and Social Development of the Russian Federation of 2011

Conditions for obtaining sick leave for caring for a grandson

Only the grandmother who is officially registered at work (according to the employment contract) according to the Labor Code of the Russian Federation has the opportunity to receive a bulletin on caring for her grandson. She must have a fixed salary, from which deductions are made regularly.

Besides, the grandmother should really look after her grandson. It is unacceptable to pay funds on a sick leave of incapacity for work, if the grandmother continues to work at the same time.

Also, registration of sick leave for caring for a grandson is impossible during the period when the grandmother is on annually paid leave or on the so-called BS (leave at her own expense), or if the grandmother is a non-working pensioner. A working grandmother, even if she is retired, has the full right to be issued and paid on sick leave, since she deducts the statutory insurance contributions from her wages (we are talking about the social insurance fund).

For how long can a grandmother take a sick leave?

First of all, it depends on how old the grandson is at the moment, and what is the degree of his illness:

  • If the grandson is not 7 years old, then a certificate of incapacity for work can be issued to the grandmother for the entire period of his illness. However, it cannot exceed 60 days (or 90 days in the case of diseases included in the list of Order No. 84H of 2008) in 12 months.
  • If the grandson is between 7 and 15 years old, then the working grandmother has the full right to paid sick leave for up to 15 days upon illness (for 12 months, such leave should not be more than 45 days).
  • To care for a teenage grandson over 15 years old, the grandmother is entitled to issue a certificate of incapacity for work for up to 3 days if the grandson is being treated at home (by decision of the medical commission, this period can be extended to 7 days).

How to register?

To apply for a sick leave, the grandmother must go to the clinic with her grandson and present her insurance policy and passport to the attending physician. After that, the doctor will draw up a form, where he will enter all the necessary data for the child.
