Even marriages made in heaven are divorced according to the earthly law. If you decide to file for divorce, you need to know what documents you need to prepare for the process. From whether the divorce will be made in court or through the registry office, the list of required documents may be different.
Instructions
Step 1
Divorce through the registry office can be carried out in the absence of a couple of minor children and with the mutual consent of both spouses. You can be divorced at the registry office if the second spouse is recognized as missing, deceased, convicted for more than three years or incapacitated.
To register a divorce, you need:
- identity documents (original and copy of the passport);
- an application for divorce, signed by both spouses, if the decision is mutual;
- a court decision on recognizing the second spouse as missing, incapacitated or dead;
- a copy of the verdict, if the spouse is convicted;
- original marriage certificate;
- a receipt for payment of the state duty.
Step 2
If the divorce is initiated only by one of the spouses, there are disagreements on the division of property or the residence of children, the divorce process is carried out through the court. In order for the trial to take place, the following documents should be submitted to the office:
- a statement of divorce and a copy of it;
- copies of identity documents;
- original marriage certificate;
- copies of documents of minor children;
- a certificate from the house management at the place of registration of the spouses;
- documents that can confirm the circumstances that prompted the dissolution of the marriage (medical certificate of beatings, evidence of treason);
- a statement confirming the spouse's consent to divorce if she is pregnant or the child is under one year old.
- a receipt for the payment of the duty.
Step 3
If the divorce is complicated by property disputes or disagreements related to the residence and maintenance of minors, several other documents must be submitted to the court. Namely:
- characteristics and a certificate of income from the place of work of both spouses;
- certificate from an independent appraiser on the value of the joint property;
- documents on the ownership of the property that is subject to division.
Getting or restoring lost documents should be taken care of before the start of the divorce proceedings.
