Russian legislation provides for the payment of a monthly allowance for caring for a child up to 1, 5 years old. Every woman whose child has not yet reached 1.5 years of age has the right to receive it.
When is a woman eligible for benefits?
Every woman caring for a baby up to 1, 5 years old has the right to receive childcare allowance. In the event that a young mother is forced to work, this allowance can be received by the person actually caring for the child. According to Russian law, only a close relative of a baby can receive benefits: dad, grandmother, grandfather, brother or sister of working age. Working women or those who actually care for a baby are paid in the accounting department at the place of work.
Some families decide that in their situation it is much more profitable to send dad or grandmother on parental leave. It all depends on the average annual income for the previous period.
If a woman does not work, then the allowance is also due to her. Only she will have to receive money not in the accounting department of the enterprise, but in the one-stop shop. In this case, the amount of the benefit will be fixed. In 2014, its size is 2576.63 rubles. A woman can receive this amount every month for her first child. For the second and subsequent children, the amount of the monthly allowance will be 5153.24 rubles.
If a woman does not work, then she will be able to receive the state allowance for caring for a child up to 1, 5 years old immediately after the birth of the baby. To do this, you need to contact the One Stop Shop and provide all the necessary documents. If a woman works, but the benefits will begin to be credited when her paid maternity leave ends.
If a relative wants to take parental leave for a child up to 1, 5 years old, and the mother at the same time goes to work, then the person who will actually take care of the soap should contact the personnel department at the place of work with a corresponding statement.
Calculation of the allowance for caring for a child up to 1, 5 years old
At present, the amount of the allowance for caring for a child under 1.5 years old must be calculated based on the average salary of an employee for the last 2 calendar years. The amount of the allowance will be 40% of the average monthly salary. In order to calculate the amount of cash payments for an incomplete month, the accountant calculates the average daily earnings and multiplies the resulting amount by the number of calendar days of the month during which the benefit should be accrued.
If the employer does not want to pay the allowance or pays it in a reduced amount, the woman has the right to go to court.
For example, a woman's maternity leave ended in April 2014. Immediately after graduation, a young mother can write an application for parental leave for a child up to 1, 5 years old. To calculate the amount of monthly payments, you need to calculate the total income of a woman for the previous 2 calendar years. In this case, 2012 and 2013 should be taken into account. The resulting amount must be divided by 730 days and multiplied by 30, 4, and then multiplied again by 0, 4. In this case, 30, 4 is the average number of calendar days in a month. The amount obtained as a result of the calculations will be equal to the size of the average monthly allowance for caring for a child up to 1.5 years old.
If the benefit starts to be paid from the middle of the month, then the average daily amount of the benefit must be multiplied by the number of calendar days during which the funds must be accrued.
