Labor legislation and laws on compulsory social insurance guarantee employees the right to leave in connection with pregnancy and childbirth and childcare with the payment of benefits calculated from the employee's average earnings.
Instructions
Step 1
In 2011-2012, for employees of their choice, the calculation of benefits in connection with pregnancy and childbirth and childcare is carried out either in accordance with the old procedure from earnings 12 months before the start of these holidays, and in the absence of a period of work and earnings, based on the size of the salary by position; or according to the procedure for calculating benefits introduced in 2011 based on earnings for the two-year period preceding the year in which the vacation begins. According to the new procedure, earnings received from previous employers are also taken into account.
Step 2
To choose the most favorable amount of benefits in connection with pregnancy and childbirth and childcare, contact the accounting department to calculate and compare earnings for 12 months before leaving for the indicated leave or for 2 years before the year of leaving on leave. Please note that according to the new order, the average daily earnings are calculated by dividing by 730 earnings received in the previous two years, regardless of the months actually worked in this period. Therefore, such a calculation is beneficial if you had higher earnings the year before last and in the previous years all months have been fully worked out.
Step 3
If you have recently changed jobs, then request data on earnings from your previous job. Then compare the average earnings calculated under the new and old rules and choose the best way to calculate benefits.
Step 4
If you did not have earnings at your new place of work, but your official salary was determined in an amount greater than the earnings that you had at your previous job, then write a statement on the calculation of benefits based on the official salary.
Step 5
After choosing the method for calculating benefits, along with applications for maternity and childbirth leave, write and submit an application for calculating benefits according to the option that is most favorable for you.
