Instructions

Step 1

Nowadays, more and more people draw up prenuptial agreements in order to avoid unnecessary conflicts when dividing property. After all, it is during a divorce that until recently people close to them turn into blood enemies. A prenuptial agreement can be concluded even before marriage or at any time in the married life. In the first case, it becomes valid immediately after registration with the registry office, and in the second - after its certification by a notary.

Step 2

In order to conclude a marriage contract, both spouses must be present. The contract itself must be certified by a notary, because without this assurance, it is not considered a legal document and does not carry any legal force.

Step 3

Before drawing up a marriage contract, you should carefully consider all the points or consult a good lawyer on this issue.

Step 4

The contract itself prescribes all the conditions for the disposal of property, both jointly acquired and personal. According to the law, without the conclusion of contracts, all property before marriage is the personal property of each of the spouses, and what was acquired in marriage is jointly acquired and is divided in half in the event of a divorce.

Step 5

In a marriage contract, you can register shared ownership with an indication of the shares for each of the spouses, or you can make a personal one, i.e. assign it to someone one. If at the time of the conclusion of the contract there was no common property yet, then after its acquisition, you can add an additional clause.

Step 6

It is also worth focusing on personal items - expensive clothes, jewelry, household appliances, etc. According to the law, in a divorce, the owner is the giver, and not the one who used it. In the contract, you can prescribe a clause where it is worth indicating who owns this or that item.

Step 7

The marriage contract may indicate the amount of moral damage for treason, betrayal, physical violence, etc. In this case, the injured party is paid compensation in a certain amount.

Step 8

After filling in all the points of the marriage contract, the signature of both of the spouses is required, as well as its certification by a notary. The contract is made in 3 copies, two of which are given to the spouses, and one remains with the notary. In case of addition of clauses to it, the spouses again turn to the same notary.
