Since January 2006, the re-registration of an apartment or a share of living space for a child has been simplified due to the fact that the tax on donation of property has been abolished. In this regard, it is easier and cheaper to re-register an apartment for a child by donating. But, nevertheless, the re-registration procedure itself is rather complicated, as it requires a lot of time.
Instructions
Step 1
To re-register an apartment or a share of living space for an adult child, first you need to collect a package of necessary documents, namely:
• certificate of ownership of the apartment;
• privatization agreement or purchase and sale agreement;
• certificate from the BTI on the appraised value of the apartment;
• a certificate from the tax office, in the event that the apartment being reissued was previously transferred to the owner by inheritance or under a gift agreement;
• extract from the personal account;
• certificate of family composition;
• certificate of absence of debt for utilities.
Step 2
In the event that a redevelopment was previously made in the apartment, it is necessary to submit documents from the housing organization confirming the legality of the redevelopment made. If the redevelopment made in the apartment is not legalized, then the collection of documents becomes more difficult. In this case, it is necessary to contact the housing organization to arrange the redevelopment in the apartment accordingly.
Step 3
After the entire package of documents has been collected, you need to contact a notary to draw up a donation agreement. When drawing up a donation agreement, the owner of the apartment and the child to whom the apartment is being re-registered must be present.
Step 4
A package of documents and a donation agreement signed in the presence of a notary are submitted for registration to the department of the Federal Registration Service at the place where the apartment was re-registered in order to legalize the child's ownership.
Step 5
If the apartment is reissued for a minor child, then a power of attorney from the child himself must be attached to the above package of documents to accept the gift. But, since the child is a minor, and he himself is not entitled to issue such a power of attorney, close relatives, for example, a grandmother, can do this for him. Accordingly, the grandmother will deal with the procedure for re-registering an apartment for a minor child and accept the apartment as a gift on behalf of the child.
Step 6
In the event that the apartment is jointly owned by two spouses, the consent of one of the spouses will be required to re-register the apartment or share of the living space for the child.
